A new lawsuit against Wise Foods claims that Wise is ripping people off with bags that aren’t ‘proportioned’ to their contents

They’re full of hot (and greasy) air.

It’s one of life’s great disappointments: You open up a bag of chips and it’s only meagerly halfway-filled with the crisp of your choice. Two customers decided to stand up for the little guy and filed a lawsuit against Wise Foods for under-filling potato chip bags. The proposed class action lawsuit claims that in comparison to snack competitors, Wise chips are ripping off consumers with chip bags that are filled up one-third of the way.

In the lawsuit, Plaintiffs Sameline Alce and Desiré Nugent provide as evidence, a 2.75-ounce bag of Wise Ridges Sour Cream and Onion chips that was only filled up 2.5 inches of its total 10-inch capacity, and called the excess space, “"nonfunctional slack-fill."

The parties are seeking damages for consumers in New York and Washington, D.C., as well as packaging changes.

Wise refused to comment on the specifics of the litigation, but was confident the company was not in the wrong:

“Wise Foods, Inc. has been in business since 1921 due in large part to our dedication to delivering a high quality product to our customers and consumers,” Jeremy R. Bjork, chief marketing officer, told The Daily Meal. “We do not believe that these claims [in the recently filed lawsuit] have merit and we are confident that the court will find that we treat our customers and consumers fairly and that our business practices are sound. Wise plans to vigorously defend this lawsuit. As the litigation is currently pending, Wise will not address the specifics of plaintiffs' allegations.
